Terms of Use

These Terms of Use (“Terms”) govern access to and use of the ChatGPT API platform (“Platform”, “we”, “us”, “our”), hosted at chatgpt-api.dev. By registering, purchasing credits, or using the Platform’s API services, you (“User”, “you”) agree to be bound by these Terms in full. If you do not agree, you may not use the Platform. ChatGPT API is an independent commercial platform. We are not affiliated with, endorsed by, or officially connected to OpenAI. “ChatGPT”, “GPT”, and “Codex” are trademarks of their respective owners.
1. User requirements
1.1. You must be at least 18 years old to use the Platform.
1.2. By using the Platform, you confirm that you have the legal capacity to enter into binding agreements.
1.3. Use is prohibited in jurisdictions where it would violate applicable law, including countries under international sanctions.
1.4. You are responsible for complying with all local laws applicable to your use of the Platform.
2. Account registration
2.1. To access the services you must register an account with accurate, current, and complete information.
2.2. You are solely responsible for keeping your credentials confidential and for all activity under your account.
2.3. You must notify us immediately (via Telegram support) if you suspect unauthorized use of your account.
2.4. We may suspend or delete accounts that provide false information or violate these Terms.
2.5. Each user may hold only one active account. Creating duplicate accounts may result in a ban.
3. Description of services
3.1. ChatGPT API provides access to OpenAI models (including GPT-5.5, GPT-5.4-pro, GPT-5.3-codex and future models) through a single API gateway.
3.2. The Platform is compatible with the official OpenAI format (Chat Completions / Responses API).
3.3. API access is provided on a credit basis. Credits are purchased in advance and consumed per token at rates 20% below official provider prices.
3.4. The Platform may offer integration with third-party developer tools (Cursor, Codex CLI, VS Code, and others).
3.5. Service availability depends on provider API availability. We target 99.9% uptime but do not guarantee uninterrupted access.
3.6. We may modify, update, or discontinue any features with reasonable prior notice.
4. Credits, pricing, and payment
4.1. Credits are sold in packs at a 20% discount to official provider prices (for example, a $400 pack is equivalent to $500 of official usage). The price shown at the time of purchase is final.
4.2. Credits do not expire and remain valid while your account is active and in good standing.
4.3. Credits are deducted in real time as tokens are consumed. A detailed usage breakdown is available in your dashboard.
4.4. Payment is accepted in cryptocurrency, including Bitcoin (BTC), Ethereum (ETH), Tether (USDT), USD Coin (USDC), and others listed on the Platform.
4.5. The Platform operates on a pay-as-you-go basis with no subscription. No recurring charges are made.
4.6. You are responsible for any taxes and fees applicable to your purchases. All prices are in US dollars (USD); for crypto payments the exchange rate applies at the time of the transaction.
5. Refunds
5.1. Credit purchases are generally final, as digital credits are delivered immediately upon payment confirmation. Conditions and exceptions are described in the separate Refund Policy.
6. Acceptable use
6.1. You agree to use the Platform only for lawful purposes, in accordance with these Terms, the providers’ usage policies, and all applicable law.
6.2. You may not use the Platform to:
- create illegal, harmful, defamatory, or obscene content, or content that infringes third-party rights;
- develop, train, or fine-tune competing AI models using API outputs;
- reverse engineer, scrape, or extract model weights or architecture;
- circumvent request limits, usage controls, or safety measures;
- resell, distribute, or sublicense API access without our express written consent;
- generate spam, phishing, disinformation, or fraudulent content.
7. Intellectual property
7.1. All Platform content (design, code, documentation, trademarks, and logos) is the property of ChatGPT API and protected by intellectual property law.
7.2. “ChatGPT”, “GPT”, “Codex”, and “OpenAI” are trademarks of their respective owners; their use is descriptive and does not imply endorsement or affiliation.
7.3. You retain ownership of content you submit through the API and grant us a limited, non-exclusive license to process it solely to produce the requested response.
7.4. API responses are generated by provider models. ChatGPT API claims no ownership over generated outputs.
8. Privacy and data
8.1. Use of the Platform is governed by our Privacy Policy, incorporated into these Terms by reference.
8.2. Your API requests and responses are not used by us to train AI models.
8.3. We collect and process only the data necessary to operate the Platform: account data, usage logs, and payment data.
9. Disclaimer of warranties
9.1. The Platform is provided “as is” and “as available”, without warranties of any kind, express or implied.
9.2. We do not warrant uninterrupted or error-free operation, accuracy of results, or that response quality will meet your expectations.
9.3. API responses are generated by provider models; we make no representations as to their accuracy, completeness, or fitness for a particular purpose.
10. Limitation of liability
10.1. To the maximum extent permitted by law, ChatGPT API and its operators are not liable for indirect, incidental, special, or punitive damages arising from use of the Platform.
10.2. Our aggregate liability for any claim shall not exceed the amount you paid us in the 30 days preceding the event giving rise to the claim.
11. Termination
11.1. You may delete your account at any time by contacting support. Unused credits are generally non-refundable upon voluntary deletion.
11.2. We may suspend or delete your account immediately for a breach of these Terms, fraudulent activity, or a threat to other users or the Platform.
11.3. Provisions that by their nature should survive termination (intellectual property, disclaimer of warranties, limitation of liability, governing law) continue to apply.
12. Changes to the Terms
12.1. We may update these Terms. The updated version is published at chatgpt-api.dev with a new effective date.
12.2. Continued use of the Platform after changes are published constitutes your acceptance of the updated Terms.
13. Governing law and dispute resolution
13.1. These Terms are governed by internationally recognized principles of commercial law and, where applicable, the law of the jurisdiction in which ChatGPT API is registered.
13.2. Disputes are first resolved through good-faith negotiation via support channels; if unresolved within 30 days, through arbitration under internationally recognized rules.
14. Miscellaneous
14.1. These Terms constitute the entire agreement between you and ChatGPT API regarding the Platform.
14.2. If any provision is found unenforceable, the remaining provisions continue in full force.
14.3. The English version of these Terms is authoritative; translations are provided for convenience.
